It landed here on Tuesday I then had work, I was in work yesterday and today I have tried it to find the above problems mentioned!
Unfortunately it isn’t working as it should and the buyer has outright refused to refund me, saying that he isn’t a shop and that for all he knows I could have done something to it! It is less than 48hrs old. I can’t afford to loose £900 like the next man but I’m not giving in on this I want my cash back my boy is 10 years old and will not have a Christmas present as I spent my cash on this for him and it is not fit for purpose

While I can totally understand your frustration a thread like this isn't doing anyone any favours.
Did you ask him what accuracy & grouping he had got from it with what pellet, & try that yourself ? perhaps a mod could now do so on your behalf
I would hope the seller did not sell it knowing it would not group when he could just have taken it back for any fault to be investigated.
I actually had a very similar situation with my FAC Rapid .25, I think it was only sold because it was so inaccurate & had I tried it first, I probably wouldn't have bought it,
But
once I got some JSB kings it's pinpoint it just won't shoot any other pellet, quite possible this rifle is equally fussy.
First thing is it needs to go across a chrono to see if the muzzle velocity is steady, then if it is, have a serious pellet testing session.
Perhaps another member close by might give some help & a fresh opinion.

What I don't understand is why Ratcatcher didn't at the very least offer to get it repaired under warranty?

I have had it over two chronographs.. 26fps extreme spread -9.7 dev (13 shots) like a shotgun at 15 yards, so bad I didn’t push the range in case it hit the fence at the back, as it is so unpredictable where the pellets are landing.
If he is a decent fella he would have replied and put this right, everything is pointing to the fact that he knew this was the case before he advertised it on here and sold it to me.
The lack of acknowledgment on his part speaks louder than words here

Unfortunately, I haven't heard anything from the seller and he hasn't been back on the forum since.
I haven't given up, but at this point it looks unlikely that he's going to volunteer to assist with the solution.
To be entirely fair to both parties, from what has been written, it is impossible for forum moderators or members to determine where blame lies in this episode. It is regrettable though that help in resolving it hasn't been forthcoming from the seller. I must also state that things happen and he may simply not have been able to get on for a while.
The seller in question has enjoyed a huge amount of free advertising on this forum and has had significant benefit. This will of course now stop.
Anyway, moving forward, you will have to take whatever action you now feel appropriate. Please keep me updated if you have any joy or otherwise.
On the bright side, another member with some experience in this type of issue has offered to inspect your gun free of charge and advise you on a specific issue he feels may be the cause of the problem. This may help get your son his Christmas present on time, which would be some consolation. If you are interested in this offer, please let me know and I'll pass you his details.

If you know it is 4 months old, that suggests that you have either got the original receipt or the shop have confirmed when it was purchased.
So I would be negotiating (without accusations) with both the shop manager and Brocock to either drive to the store (or have it returned) so that they can at least advise you what the issue is. However, based on the title of this thread, I suspect that you may have already burned your bridges with the store.
Because, unfortunately, you don't stand a cat in hells chance of success in either a police claim (not going to happen) or a civil case, because unless the gun was received physically damaged (and immediately recorded/evidenced as such) you just cannot prove your case (or that you have not tampered with it yourself).
